Family Law No. (23) Of 2006 stipulates that cases and disputes related to family and inheritance matters shall be adjudicated by one or more circuits of the Court of First Instance and the Court of Appeal, called the Family Court. It also permitted the Family Court of the Court of First Instance, which is composed of a single judge, to adjudicate disputes related to family and inheritance matters determined by the Supreme Judicial Council.
The Council issued Resolution No.23 Of 2006 specifying family- related lawsuits and disputes that are heard by the Court of First Instance formed by a single judge and called it the Partial Family Court, and lawsuits and disputes related to family matters that are heard by the Court of First Instance formed of three judges and called it the Plenary Family Court. It is noteworthy that these lawsuits and disputes fall under the disputes related to personal status, However, the Family Law has excluded them and gave the Family Court the jurisdiction to hear them. The other personal status disputes remain under the jurisdiction of the Plenary Court.
